Terms & Conditions
Welcome to Clickonprint.
Your use of the Clickonprint Photobook software and/or the Clickonprint website (referred to collectively as a “service”) is subject to the terms of a legal agreement between you and Clickonprint Pty Ltd. "Clickonprint" means Clickonprint Pty Ltd as trustee for the Bamforth Investment Trust, whose principal place of business is at 300 Ann St, Brisbane, Queensland 4001, Australia. By using our service you agree to comply with and be bound by the following terms and conditions of use, which together with our privacy policy, govern Clickonprint Pty Ltd's relationship with you in relation to this service.
The term “Clickonprint Pty Ltd” or “us” or “we” or “our” refers to the owner of the service. The term “you” refers to the user or viewer of our service. The term “the software” refers to the Clickonprint Photobook software.
The use of this service is subject to the following terms of use:
1. Introduction:
a. The content of the pages of this service is for your general information and use only. It is subject to change without notice.
b. By using the Clickonprint website and/or our Clickonprint Photobook software you agree to abide by the terms and conditions set out in this document, otherwise please refrain from using our service.
2. Software:
a. Please read the following requirements carefully, before installing the Clickonprint Photobook software, using it, copying it or passing it on to a third party. If you do not agree with these terms and conditions, you are not permitted to install or use the software.
b. Clickonprint Pty Ltd will give you the authority for installation and usage of the software.
c. You are allowed to make copies of the software and pass it on to others.
d. To sell, rent or use the software for leasing is prohibited.
e. The commercial assignment of the Clickonprint Pty Ltd software is explicitly forbidden without a written authorisation from us.
f. You are prohibited from reverse engineering, decompiling the Clickonprint Photobook software, or trying to determine the source text or any other information about the data structure.
g. Clickonprint Pty Ltd reserves the right to take any action it deems appropriate if and when it feels any of the items specified in this section have been breeched.
h. In no event will we be liable to you for any damages, including any lost profits, lost savings, or other incidental or consequential damages arising from the use or the inability to use the software and/or the Clickonprint website (even if we or an authorized dealer or distributor has been advised of the possibility of these damages), or for any claim by any other party.
i. Please refer to Software License Agreement within the Software package when installing it on your PC for the comprehensive Software License Agreement details.
3. Orders:
a. Only upon the receipt an email from Clickonprint confirming that your order has been successfully uploaded and payment has been transacted, can you consider the order accepted and in production.
b. Please make sure to update your software version before every use of the software. An update message will automatically be displayed each time the software is launched. The update is to ensure you are using the latest version of our software with our current products, services and pricing. Pricing and product updates will be displayed on our website.
c. Due to the automated process involved in printing your PhotoBook please note that we do not and can not control its content nor can we be held responsible for any content errors, such as mistakes in spelling or layout. The PhotoBook will be printed just as it appears in the ‘preview’ screen. Please proof read your PhotoBook content prior and check your PhotoBook layout prior to submitting your order to Clickonprint.
d. All completed orders are archived by Clickonprint for a period of 90 days, after which they will be deleted.
4. Delivery:
a. Clickonprint aims to complete and despatch all orders in approximately 10 working days from payment. Some upgrade options (eg. linen photocovers, foil embossing, upgraded paper stocks) may require additional days to complete. If for whatever reason delivery will be delayed beyond our standard production timeframe we will endeavour to contact you however a delay in production/delivery will not be accepted as grounds for an order cancellation or request for any form of compensation.
b. All Clickonprint PhotoBooks are professionally handled and packaged to avoid any damage during delivery, however we are not liable for damage caused in transit by third party transport providers and their agents.
c. Clickonprint PhotoBooks may be delivered using the Australia Post Express Parcel Service and delivered to your nominated postal address.
5. Liability:
a. Clickonprint Pty Ltd will not accept any liability for damage or loss of files.
b. Clickonprint Pty Ltd emphasizes that the print quality of the PhotoBooks will be directly related to the resolution of the images you use in your PhotoBook layout. You will be warned in our software when image resolution becomes to low, a red triangle with exclamation mark will be displayed in the bottom right of the image frame.
c. You are solely responsible for all proofing of the PhotoBook content, including text, images and layout and that by placing an order you warrant that the content is approved and you agree that it is ready to print as is.
6. Copyright:
a. Clickonprint will not be held liable for any copyright infringement relating to your PhotoBook material, you are solely responsible for all copyright issues concerning your order and by placing an order you warrant that either you are the copyright holder, or you have the express written permission of the copyright holder to do so.
b. Clickonprint does not accept any responsibility for the content or correctness of the order files you submit.
c. In ordering and distributing your printed PhotoBooks you are solely responsible for strictly observing all related laws within Australia and those countries to which the Clickonprint PhotoBooks are to be distributed.
d. You retain copyright and any other rights you already hold in content which you upload to, order with or share through Clickonprint. By submitting your order you give Clickonprint a worldwide, royalty-free, and non-exclusive license to print, archive and share any content which you submit through the Clickonprint service for the sole purpose of enabling Clickonprint to produce your order, archive for future reorders and to facilitate the sharing of your artwork via social networks or embedded previews. We respect your copyright and will never reuse, publically share or repurpose your artwork without your explicit written permission.
7. Guarantee:
a. Any and all complaints must be submitted to Clickonprint within 14 days of PhotoBook delivery date. Please contact us via email at support@clickonprint.com.au or on free call 1800 125 425.
b. Clickonprint will investigate each complaint and should it be found to be justified Clickonprint will, at its own discretion supply you with a replacement PhotoBook (reprint existing order only); or provide you with a refund less the cost of delivery. The original / damaged PhotoBook must be returned to Clickonprint Pty Ltd at your expense.
c. Clickonprint Pty Ltd provides a twelve (12) month manufactures guarantee against any manufacturing defects in our PhotoBook products. This guarantee is valid for one year from the date of the initial order. This guarantee is limited to print production or binding defects only; it does not cover any damage caused from, but not limited to: intentional or unintentional misuse/mishandling, 'wear and tear', or improper storage.
8. General:
a. Improper use of the Clickonprint website and our Photobook software is forbidden, this includes but is not limited to usage of copyright material, pornographic material, or any other illegal content.
b. Clickonprint Pty Ltd will not be held liable for such improper use of its software, you are solely responsible for all copyright issues relating to your order.
c. The use of Clickonprint website and our PhotoBook software is for those people that have filled in the membership details or have otherwise supplied us with their full details, only true and legitimate email addresses and personal details are to be used.
d. Underage children may use the website and our software with the permission of an adult who is the credit card owner (for payment purposes) and registers under his / her name.
e. Clickonprint Pty Ltd maintains the right to deny access to our website and our software to anyone who we deem has acted against the letter and spirit of these terms and conditions.
f. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
g. Your use of any information or materials on this service is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this service meet your specific requirements.
h. This service contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
i. Unauthorised use of this service may give to a claim for damages and/or be a criminal offence.
j. From time to time this service may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
k. Your use of this Service and any dispute arising out of such use of the Service is subject to the laws of the State of Queensland and Australia.
